terms of service.
1. Changes
The client will be responsible for additional fees accrued based on requests made by the Client outside of the agreed upon scope. Fees will be charged at a rate of $30/hr.
2. Fee Schedule
For all projects under USD 500, the full amount is due before work begins. For projects exceeding USD 500, 50% of the total project fee is due upon contract acceptance, with the remaining balance due upon completion of the project.
If a payment plan is agreed upon, the Client is responsible for completing all scheduled payments in full, according to the agreed timeline. Work will not be handed over until the full balance has been received. Late or missed payments may result in work being paused until the balance is brought current. All payments made, including installment payments, are non-refundable and cover work completed up to that point.
Invoices must be paid within 3 days of receipt. Late payments are subject to a 5% service charge.
3. Ownership
All preparation materials, sketches, visuals, including the electronic files used to create the project remain the property of The Dgtl Bar, LLC. The final artwork/digital files will become the property of the Client mentioned in this proposal ONLY upon final payment of the project. Should the client attempt to use/modify/alter/replicate any ideas without making agreed final payment, legal counsel will be taken.
4. Suspension, Refund, Cancellation
I reserve the right to suspend any project if Client: interferes with excessive micromanaging, demonstrates a continued lack of trust and ability to move forward after showing more than a reasonable number of unique ideas/concepts and/or shows a reluctance in paying final payment.
Client reserves the right to suspend or cancel any project should work completed not meet project objectives as defined in initial planning phases of the customer service experience not meet clearly defined expectations.
Fair notice will be given by either party with fair chance to remedy the situation without resorting to project suspension or cancellation.
Either party may terminate the project if the other party materially breaches this agreement and fails to remedy the breach within seven (7) days of written notice. Material breaches include, but are not limited to, failure to make scheduled payments or failure to provide required materials or approvals.
If the project is terminated, all payments made are non-refundable, and The Dgtl Bar retains ownership of all work completed, preliminary files, and concepts. Work in progress will not be delivered until all outstanding payments are received.
The Dgtl Bar, LLC does not provide refunds for any services. Having buyers remorse or wanting to use another company instead is not a suitable means for a refund. Once payment has been made, the sale is final. It is advised that you give your project sufficient time for completion for these reasons: revisions may be needed, there may be a peak in the orders received or prior orders may take slightly longer than expected.
5. Hours & Communication
All project communication with The Dgtl Bar, LLC shall be done strictly via client portal, email and text. For our protection and the Client, written documentation of all communication is mandatory. For paper trail purposes, The Dgtl Bar, LLC accepts Zoom consultations and clients agree to recording of video call for reference during project. This will ensure that there are no misunderstandings during the process. No communication will be done outside of business hours Tuesday-Friday 9AM-6PM EST or on holidays.
6. Timeframes
Turnaround times for all projects may vary and are subject to change at anytime. Client is given estimated timeframe for project. Our goal is to complete all projects within the timeframe, but some may require more time. All project timeframes are an estimate and are subject to change due to workload or unforeseen issues. If for any reason we need to extend the project timeframe, the client will be notified. If needed and there is availability, The Dgtl Bar, LLC does offer a rush option for an additional cost.
7. Act Of God
If a legal “Act of God” occurs during your project (ex: fire, flood, computer/hardware damage, death in the family ect.) The client will be notified to discuss new deadlines for the project.
8. Permissions
The Dgtl Bar, LLC will have portfolio rights to share the completed work designed on social media, and the business website. This will be used for self-promotion.
9. Design Content
It is important to have a vision of some kind for your business so it can be relayed to me. If you want me to freestyle my ideas for your project, keep in mind our creative visions may not match. This can lead to more revisions than needed. It is best to at least have some form on concept on the project you are purchasing. Client is required to submit all HIGH QUALITY photos and/or verbiage (text) they need for their project. Pixelated photos will result in a subpar look. Please refrain from submitting any dull phone images, screenshots or low quality photos. Please make sure all submitted content is spell checked and not subject to copyright. We may revise submitted content if deemed necessary for the the project. Any revisions on our end will be communicated first.
10. File Types
Client will receive JPG and PNG files for all designs. EPS. Or PDF may be included depending on the design order placed. If you need a specific file please make sure to send The Dgtl Bar, LLC an email. All raw PSD/AI files remain the property of The Dgtl Bar, LLC even if you are provided the file.
